Restaurant Partner Terms

bite.je is a Jersey business built to support Jersey restaurants. Our goal is simple: to give local food businesses a platform to reach more customers in their community, without the overheads and complexity of the big delivery apps. These terms govern the relationship between bite.je (“we”, “us”, “the platform”) and restaurants and food businesses (“Partner”, “you”) who list their menus on our platform. By registering as a Partner, you agree to these terms.

1. Platform Role

bite.je is an ordering intermediary connecting Jersey customers with Jersey restaurants. We facilitate orders between your customers and your business, keeping things local and straightforward. We are not a party to the contract of sale between you and your customers — that contract is formed between you and the customer when you accept an order. We act as your commercial agent for the purposes of receiving payments on your behalf.

2. What We Commit to You

We are a local business, and so are you. We want bite.je to genuinely work for the restaurants on it — not just the customers. Here is what you can expect from us:

  • We will maintain a reliable platform and do our best to ensure orders are transmitted to you accurately and promptly.
  • We will process payments via Stripe and remit your earnings to your nominated account on the schedule agreed during onboarding. If there is ever a delay on our side, we will let you know.
  • We will promote your restaurant to customers in Jersey through the platform and, where we can, through our own marketing — and we will always represent you fairly.
  • If something goes wrong on our side — a platform outage, a missed order, a payment error — we will be upfront with you about it and work with you to put it right.
  • Our team is available to help with questions about your listing, the platform, and your account. We aim to respond to Partner queries promptly.
  • We will aim to keep you informed of any changes to platform requirements that affect how you operate on bite.je. Jersey is a small island — if something changes on our side that you need to know about, we will tell you.

3. Registration & Eligibility

  • You must be a lawfully operating food business in Jersey, Channel Islands, registered under the Food (Registration of Premises) (Jersey) Order 2001 or any successor legislation.
  • You must hold all permits, licences, and registrations required by law for the products you sell, including a licence under the Licensing (Jersey) Law 1974 if you sell alcohol.
  • You must provide accurate information during registration and keep it up to date. We reserve the right to verify your registration details with the relevant authorities.
  • Applications are subject to approval. We want bite.je to be home to local restaurants that share our commitment to quality and the Jersey community — if we don't think it's a good fit, we will always try to explain why.

4. Menu Accuracy

  • You are solely responsible for the accuracy, completeness, and legality of your menu content, including item names, descriptions, prices, and availability.
  • Prices displayed must be GST-inclusive (Jersey GST at 5%) and in British Pounds Sterling.
  • You must keep your menu up to date. Orders placed for unavailable items must be declined promptly and the customer refunded in full.
  • We reserve the right to remove or suspend listings that are inaccurate, misleading, or in breach of applicable law.

5. Allergen Information

We know that managing allergen information carefully matters — both for your customers and for your business. Here is what we ask of you:

  • You are responsible for providing accurate allergen information for every menu item. bite.je displays the information you provide in good faith, but you remain solely liable for its accuracy.
  • Allergen data must be kept current. If a recipe or ingredient changes, you must update your menu promptly.
  • Customers with allergies may contact you directly before ordering — your phone number is displayed on your menu page for this purpose. You must be able to answer allergen queries accurately.
  • Nothing in these terms limits your obligations under applicable food safety and labelling legislation.

6. Age-Restricted Products

Jersey licensing law places clear obligations on businesses selling alcohol and age-restricted products. We will support you in understanding what those requirements mean for your listing on bite.je — but the responsibility for compliance rests with you as the licence holder:

  • If you sell alcohol or other age-restricted products, you must comply with all requirements of the Licensing (Jersey) Law 1974 and any conditions attached to your licence.
  • You or your delivery driver must verify the customer's age before handing over any age-restricted order. If the customer cannot produce acceptable proof of age, you must refuse delivery.
  • You must not supply age-restricted products to anyone you reasonably suspect to be under the legal age.

7. Order Fulfilment

  • You must accept or reject each order promptly. Consistent failure to respond within a reasonable time may result in suspension of your listing.
  • Accepted orders must be fulfilled to the specification shown on the platform at the time of order placement — that is, the items ordered at the prices confirmed. Where an order cannot be fulfilled within the estimated delivery or collection time, the restaurant must take reasonable steps to notify the customer as promptly as possible.
  • If you cannot fulfil an order, you must cancel it and the customer will be refunded in full. Repeat cancellations may result in suspension.
  • Delivery times displayed on the platform are estimates. You are responsible for communicating realistic delivery windows and for keeping estimated times up to date.

8. Food Safety & Hygiene

  • You must comply with all applicable food safety, hygiene, and labelling legislation in Jersey, including any Orders made under the Food Safety (Jersey) Law 1966 or successor legislation.
  • You must hold a current food hygiene rating (where applicable) and make it available to us on request.
  • Any food safety enforcement action taken against your business must be notified to us as soon as reasonably practicable. We may suspend your listing pending investigation.

9. Fees & Payment

  • bite.je charges a commission on orders placed through the platform. The applicable commission rate is agreed separately and set out in your onboarding agreement.
  • Payments are processed via Stripe. Customer payments less our commission are remitted to your nominated bank account on the schedule agreed during onboarding.
  • We reserve the right to withhold payment in respect of disputed orders or where we reasonably suspect fraudulent activity.

10. Data Protection

As two Jersey-based businesses handling customer data, we both have obligations under local data protection law. Here is how we expect that to work in practice:

  • Both parties must comply with the Data Protection (Jersey) Law 2018 (“DPJL 2018”) in respect of any personal data processed in connection with the platform.
  • Customer personal data (including name, contact details, and delivery address) shared with you for the purpose of fulfilling an order must be used only for that purpose and must not be retained beyond the period necessary to fulfil the order.
  • You must not use customer data for marketing without obtaining the necessary consents under the DPJL 2018.

11. Suspension & Termination

We hope this never becomes necessary — our goal is a long-term partnership with every restaurant on the platform. If issues do arise, we will always try to resolve them by conversation first.

  • Either party may terminate this agreement on 30 days' written notice.
  • We may suspend or terminate your access immediately if you are in material breach of these terms, if your food safety or licensing status changes, or if we reasonably believe that continued listing poses a risk to customers.
  • On termination, all outstanding amounts owed by either party will be settled within 30 days.

12. Your Content

When you share content with us — such as your business name, logo, menu descriptions, and photographs — you are giving us permission to use it to showcase your restaurant on the platform and in our marketing. We will always use it to represent you fairly and accurately, and only for as long as you remain a Partner. We will not sell or license your content to third parties. In return, please make sure that any content you provide is yours to share and does not belong to someone else.

13. Responsibility

bite.je and its Partners each take responsibility for the parts of the service within their own control. As a platform, we take responsibility for operating a reliable ordering service, processing payments accurately, and transmitting orders to you in good time. As a Partner, you take responsibility for the food and drink you prepare and supply — including its safety, quality, and accuracy of description — as well as compliance with the licensing, food safety, and allergen obligations that apply to your business. Where a customer suffers a loss that arises from something within your control rather than ours, we would expect you to work with us in good faith to resolve it, and where necessary to cover any reasonable costs that fall to bite.je as a direct result. We recognise that problems are rarely straightforward and we will always aim to discuss these situations with you before taking any formal steps.

14. Changes to These Terms

We may update these terms from time to time as the platform grows and evolves. If we make any material changes, we will give you reasonable advance notice by email before they take effect. If you continue to use the platform after that, we will take that as your acceptance of the updated terms. For minor or clarifying changes — for example, correcting a typo or updating a legal reference — we may make updates without advance notice.

15. Governing Law

These terms are governed by the laws of Jersey, Channel Islands. Any disputes shall be subject to the exclusive jurisdiction of the Royal Court of Jersey.
